1. Acceptance of Terms
By accessing or using the Ditto app ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. We reserve the right to update these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.
2. Eligibility
You must be at least 13 years old to use Ditto. If you are under 18, you represent that you have your parent or guardian's permission to use the Service. By using Ditto, you represent and warrant that you meet these eligibility requirements.
3. User Accounts
To use certain features of Ditto, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.
4. User Content & Ownership
You retain ownership of all photos, images, and other content you upload to Ditto ("User Content"). By posting User Content, you grant Ditto a non-exclusive, worldwide, royalty-free licence to use, display, reproduce, and distribute your User Content solely for the purpose of operating and improving the Service. You represent that you have the right to share any content you upload and that it does not infringe on any third party's rights.
5. Acceptable Use
You agree not to use Ditto to:
- Upload or share content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
- Upload sexually explicit or pornographic material
- Impersonate any person or entity
- Spam, solicit, or advertise without permission
- Attempt to gain unauthorised access to other accounts or systems
- Upload malware, viruses, or other harmful code
- Harass, bully, or intimidate other users
- Use automated tools to scrape or collect data from the Service
We reserve the right to remove any content that violates these guidelines without notice.
6. Intellectual Property
The Ditto app, including its design, logos, trademarks, and underlying code, is the property of Ditto and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.
7. Challenges & Interactions
Ditto allows users to create and participate in photo challenges. You acknowledge that challenge results, including winner selection, are determined by community engagement (likes and votes). Ditto does not guarantee any specific outcome and is not responsible for the fairness or accuracy of community-driven results.
8. Account Termination
We may suspend or terminate your account at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to, violation of these Terms, abusive behaviour, or extended periods of inactivity. You may delete your account at any time through the app settings. Upon termination, your right to use the Service will immediately cease.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. Your use of the Service is at your sole risk.
10. Limitation of Liability
To the maximum extent permitted by law, Ditto and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service. Our total liability for any claim arising from or relating to these Terms shall not exceed the amount you paid us, if any, in the 12 months prior to the claim.
11. Indemnification
You agree to indemnify, defend, and hold harmless Ditto and its affiliates from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.
12. Third-Party Services
Ditto may contain links to or integrate with third-party services (e.g., Firebase, Google Cloud). We are not responsible for the content, privacy practices, or terms of any third-party services. Your use of such services is governed by their own terms and policies.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
